One of the most serious drawbacks of a sublease is the possibility that the sublessor stops paying the rent. In this case, you may also become subject to the default and the consequences included in such an action. You can attempt to overcome this problem after striking a financial agreement with the sublessor, by obtaining a "novation" of the lease from the master lessor. With a novation, you might have some bargaining power for extra tenant improvement dollars and a commitment for a longer term. Another option is to ask your attorney to provide a non-disturbance clause in the lease when you begin negotiating the final contract.
